Terms of Service
1. About the Store
This store is operated by Chantal De Serres, an artist based in Quebec, and hosted on the Shopify platform. These terms govern the use of the website and the purchase of artworks offered through it.
The Shipping Policy, Return and Refund Policy, and Privacy Policy supplement these terms. Nothing in these terms limits the protections provided by applicable laws.
2. Artworks and Their Presentation
Original artworks are offered according to the specifications provided in each listing, including dimensions, materials, support, framing and available display orientations.
Photographs represent the artworks as faithfully as possible. Their appearance may vary slightly depending on your screen and its settings. Images showing artworks in interior settings illustrate their presence in a room; the furniture and accessories shown are not included. Please refer to the dimensions in the listing for the artwork’s actual size.
Framing is included only when expressly stated in the listing.
3. Prices, Payment and Orders
Prices are listed in Canadian dollars. Applicable taxes and shipping charges are shown before the purchase is finalized. When a shipping quote is required, its terms are agreed upon before the order is placed.
You must provide accurate contact and delivery information. An order confirmation is sent to the email address provided at the time of purchase.
Subsequent changes to prices, descriptions or these terms do not alter the terms of a purchase already concluded.
To request a change or cancellation before shipping, please contact me promptly. Each request is considered in light of the order’s preparation status and your rights under applicable law.
4. Shipping and Pickup
Orders intended for shipping generally require 5 to 7 business days of preparation after payment is confirmed. Transit time is additional and varies depending on the destination and the service selected.
Large artworks and those requiring special transportation arrangements are quoted before purchase.
Studio pickup is free and available by appointment only. Orders are generally ready within 2 to 4 days; please wait for the notification and arrange an appointment before visiting.
Full details are provided in the Shipping Policy. In the event of a delay, loss or damage during shipping, please contact me to arrange the follow-up. Legal protections continue to apply.
5. Returns and Refunds
You may request a change-of-mind return within 14 days of receiving the artwork or picking it up, subject to the conditions set out in the Return and Refund Policy.
That policy explains the requirements for protecting the artwork, return shipping costs and refund procedures. Damaged, defective or incorrect artworks are handled according to the circumstances and applicable laws.
6. Copyright
The purchase of an original artwork covers the physical object. It does not transfer copyright or grant permission to reproduce the artwork or use it commercially.
To reproduce an artwork or use images and text from the website beyond uses permitted by law, please obtain prior written permission.
7. Personal Information and Website Use
Personal information is processed in accordance with the store’s Privacy Policy.
You agree to use the website lawfully, without compromising its security, transmitting malicious content or infringing the rights of others.
8. Relationship with Shopify
Chantal De Serres is powered by Shopify, which enables us to provide the Services to you. However, any sale or purchase made through our Store is conducted directly with Chantal De Serres. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Chantal De Serres, including any damage, injury or loss resulting from the products or services purchased. You hereby expressly release Shopify and its affiliates from any claims, damages and liabilities arising from or related to your purchase and transaction with Chantal De Serres.
This provision applies only to the extent permitted by applicable laws and does not remove any rights that you cannot legally waive.
9. Governing Law and Updates
These terms are governed by the laws of Quebec and the applicable federal laws of Canada, subject to any mandatory protections that may apply in your province or territory of residence.
These terms may be updated for future purchases. The version applicable to your order is the one in effect at the time of purchase.
